Apple Files to Trademark “Mountain Lion” OS X

On July 9, Apple filed with the USPTO to obtain trademarks for the marks “Mountain Lion” and “OS X Mountain Lion.”  Mountain Lion, or OS
X 10.8, is the new operating system for Mac products that is scheduled for release this month.  Whether the “Mountain Lion” mark will meet the statutory requirement of “distinctiveness” is yet to be seen.  Although the company successfully trademarked its “Snow Leopard” software name, it recently was accused of trademark infringement by a Chinese houshold goods company.  All of this comes on the heels of a $60M settlement with a Chinese company over the trademark for “iPad.”
